Clerk’s Hearings


If you have been summonsed to appear at a Clerk’s Hearing, also called a Probable Cause Hearing, you have a chance to win your case before it even gets to Arraignment. This means that it would not appear on your record as a criminal case.

A Clerk’s Hearing is an informal hearing at the Court before a final decision on criminal charges has been brought.  It is usually off the record in a conference room at the Clerk’s office.  Some courts create a more formal recorded proceeding.  You have a right to be represented by counsel at this proceeding and taking advantage of that right can make all the difference.  Many cases are settled before the Clerk’s Hearing even happens.  In many other cases a good defense can be presented at the hearing, convincing the Clerk to not even issue a Complaint.  Getting ahead of the hearing is essential.
